Martin Flaškár specializes in public investment, binding legal relations, especially in the field of ICT law and copyright law, and the legal aspects of transport and logistics, as well as in public support law.

As part of his practice, he provides comprehensive legal advice in the preparation of complex technological and transport-logistics projects in the public sector, incl. comprehensive preparation of tender and contractual conditions for these projects, as well as advice to major private entities operating in the ICT and transport telematics market, primarily in the position of bidders for public contracts and in connection with the setting up of contractual documentation.

Martin Flaškár actively deals with the issue of transport – telematics systems, development and the practical application of new technologies in practice such as autonomous mobility, electromobility and intelligent transport systems, projects related to transport services and transport telematics in general, as well as ICT systems and their implementation. Martin has extensive experience in providing legal support in the preparation of many major projects worth at least CZK 100 million and in providing legal support to applicants for the most important public contracts awarded in the Czech Republic, including projects co-financed by European Union operational programs. He also provides legal opinions on key issues in the field of ICT law, public procurement law, data protection and personal data in transport – telematics systems, as well as in the field of public support, and has experience in proceedings before the Office for the Protection of Competition.

Martin Flaškár is the co-author of a commentary on the Public Procurement Act, and is also active in publishing professional articles, especially related to current issues in ICT law and intellectual property law, public procurement law and he pursues teaching activities in the field of ICT law, as well as in the field of transport telematics systems.

Contracting authority – the Czech Republic’s Ministry of Agriculture, public procurement, “Operation and development eAGRI and related application infrastructure.”

Provided comprehensive legal services related to the successful launch of the public procurement with a value of nearly 300 million CZK, not including VAT. Contracting authority – the Czech Republic’s Ministry of Agriculture, public contract “ICT Services for the operation of the Ministry of Agriculture 2012-2013”.

Participated in providing legal services related to the assessment of aspects of public support for a project with a value of over 1 billion CZK, not including VAT. Contracting authority – Prague 8, public procurement, “Centrum Palmovka. Construction of office buildings and commercial spaces and their subsequent administration with the provision of related services”, entered in a competitive dialogue.

Provided comprehensive legal services related to the successful launch of the public procurement with a value exceeding 300 million CZK, not including VAT.  Contracting authority – the Centre for Evaluation of Educational Achievement, public procurement “Systems management and supervision center, data capture and integration infrastructure, logistic support of the unified school graduation examination (RDC, DDS, I)”.

Provided comprehensive legal services related to the successful submission of the procurement with a value of nearly 200 million CZK, not including VAT. Contracting authority – the National Library of the Czech Republic, a public procurement “system integrator of the project Creation of the National digital library”. In the context of this legal service, Martin participated in the creation of the specified tender conditions containing a binding model contract, which concerned the project to create a national digital library. This contract is financed from the integrated operational program.

Provided comprehensive legal service relating to the successful submission of the procurement with a value of nearly 1 billion CZK, not including VAT. Submitter – Air Traffic Control for the Czech Republic, a public procurement, “Replacement of the Main System”, tender submitted in a competitive dialogue and subsequently in a negotiated procedure with publication, which was executed completely in English.

Provided comprehensive legal advice to the Czech Republic’s Ministry of Labor and Social Affairs as the contracting authority for individual contracts for the implementation of individual systems creating a Unified Information System for Labor and Social Affairs (JISPSV), in connection with the award of public procurements with an estimated value in excess of 1 billion CZK, not including VAT.

Provided comprehensive legal advice to the Czech Republic’s Home Office during the so-called redefinition of the main contract concluded with the Czech Post Office, specifically the branch of ICT to provide comprehensive communications infrastructure.

Provided comprehensive legal advice to the Czech Republic’s Home Office in transforming the Czech Post, specifically the ICT branch office, to form an independent state enterprise. Within this project, Martin participated in the assessment of possible methods for this transformation, as well as the impact of these as regards equity, contracts, employment law and project relationships in the Czech Post´s ICT branch office.

Provided comprehensive legal advice to the city of Prague in solving current problems within the Opencard project, as well as in the search for a suitable and sustainable solution for a future transport-dispatch system in the area of Prague´s so-called integrated transport network.

Provided comprehensive legal advice to the city of Prague in solving  current problems associated with the existing ERP system GINIS, as well as in the search for suitable and sustainable solutions for future implementation and integration of information systems for the City of Prague´s city districts and financial aid organizations. Contracting authority – Czech Republic – Ministry of Agriculture, public contract “ICT Services for the operation of the Ministry of Agriculture 2012-2013”. Providing comprehensive legal services related to the successful launch of a public procurement with a value of nearly 300 million CZK without VAT. Under the Legal Services he also participated in the preparation of the tender specifications containing a binding model contract, which included the provision of services for the operation of the complete and robust ICT infrastructure of the Ministry.
